This Privacy Policy Notice applies to Berkshire Hathaway HomeServices Florida Realty ("BHHS Florida Realty") in connection with your use of our services. Although we are a subsidiary of HomeServices of America (HSoA), please note that this Privacy Policy Notice does not apply to any other HSoA Affiliates or the websites of such Affiliates if such entity has adopted a different Privacy Policy and/or Legal Notices. Unless otherwise specified, "HSoA Affiliates" includes HomeServices of America, Inc. and all applicable affiliated companies. Please note that where a HSoA Affiliate has individually adopted a different Privacy Policy, Terms and Conditions and/or Legal Disclaimers, such Privacy Policy, Terms and Conditions and/or Legal Disclaimers will supersede this Privacy Policy Notice for purposes of that HSoA Affiliate.

Except as otherwise specifically provided in this Privacy Policy Notice or as specifically required by law, any communication or material you provide to us, whether received online, electronically, in person, or otherwise collected by or submitted to us, including any data, questions, comments, suggestions or the like, is, and will be treated as, non-proprietary. Anything you submit, transmit or post may be used for any purpose, including, but not limited to, reproduction, disclosure, transmission, publication, market research, development of prospect lists, project planning, broadcast, posting and marketing, among other things, as permitted by law and except as otherwise provided in this Privacy Policy Notice.

Categories of Information We Collect

As a general matter, we may collect nonpublic personal information about you from the following sources:

• Information we receive from you on applications and other forms; and
• Information about your transactions with us, HSoA Affiliates, and others.

The following are specific examples of nonpublic personal information about you that we collect:

• Contact Information: We may request and collect, without limitation, your name, address, email address, home telephone number,
• work telephone number, fax number and cell phone number.
• Additional Information About You: We may request and collect, without limitation, information about your home search, including the community you are searching in and the anticipated closing date.

Additionally, in connection with the use of our websites, we collect certain web analytics information, including, among other information, the number of website visitors, session time, and browser version (technical information). Technical information is not collected in a manner in which it can be tied to a specific user and is stored and used only on an aggregate basis. Some of our services are provided to or through affiliated websites when you access the websites. The personal information you provide to those sites may be sent to our websites to deliver the service. We process such information in accordance with this Privacy Policy Notice. We will store on the computer that you use to access the websites a small file that commonly is referred to as a "cookie." The cookie has information that enables us to recognize a specific computer used to visit the websites. Each vendor identified on, or accessed from, the websites has its own policies on the collection and use of technical information and the use of cookies. 

In some cases, we may combine information we collect in connection with your use of our services with information collected from other online and offline sources.

Information Sharing with Affiliates. Except as provided below, we may disclose your nonpublic personal information with HSoA Affiliates.

Notice of Your Choice to Limit Marketing. You may limit HSoA Affiliates, such as our affiliated mortgage lender or broker and insurance affiliates, from marketing their products or services to you based on your personal information that we collect and share with them. Your choice to limit marketing offers from HSoA Affiliates will apply until you tell us to change your notice preferences. If you wish to limit marketing offers, notify us as described below.

Cookies and Interest - Based Advertising

We may use cookies and other devices on our websites. Using cookies on our sites provides benefits to you, such as allowing you to maintain your account login information between visits. For International Consumers

Servers in the United States host our consumer applications. If you are located outside of the United States, your personal information may be transferred to the United States. By submitting your personal information, you consent to its transfer to the United States and to its storage, processing, and use there in accordance with this Privacy Policy Notice.

European Union Residents and General Data Protection Regulation Information

If the General Data Protection Regulation "GDPR" (a privacy law applicable to consumers residing in the European Economic Area) applies to a specific transaction and/or a specific consumer, any such consumer has the below rights.

Right of access. You have the right to obtain from us confirmation as to whether or not personal information concerning you is processed, and to request access to your personal information.

Right to correct or update. You have the right to correct or update inaccurate personal information about you.

Right to be forgotten. Under certain circumstances, you have the right to request that your personal information be erased. Some personal information may be in backup archives and/or must be retained for legal or compliance reasons.

If you have been referred to us by a third party corporate client or a relocation services company, we are acting as a "Data Processor" under the direction of such corporate client or relocation services company, which are deemed "Data Controllers" under GDPR. The Data Controller is responsible for telling us how your personal information should be used or processed in those specific transactions.

Security

We restrict access to nonpublic personal information about you to those employees who need to know that information to provide products or services to you. We maintain physical, electronic, and procedural safeguards that comply with federal regulations to guard your nonpublic personal information.
